ComparisonHQ is committed to operating in full compliance with all applicable Australian laws and regulations. We recognise the importance of maintaining the trust of our users, participating providers, and regulatory bodies.
Australian Consumer Law
We comply with the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), enforced by the Australian Competition and Consumer Commission (ACCC). This includes our obligations to:
- Not engage in misleading or deceptive conduct.
- Not make false or misleading representations about products or services.
- Ensure all comparisons are fair, accurate, and transparent.
- Clearly disclose the scope of our comparison services, including which providers and products are included.
- Clearly disclose how we are remunerated for our services.
Privacy Act 1988
We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), regulated by the Office of the Australian Information Commissioner (OAIC). Spam Act 2003
We comply with the Spam Act 2003 (Cth), regulated by the Australian Communications and Media Authority (ACMA). All commercial electronic messages sent by ComparisonHQ include clear sender identification, a functional unsubscribe mechanism, and are only sent with appropriate consent.
ACCC Comparator Website Guidelines
ComparisonHQ operates in accordance with the ACCC's published guidance and findings on the comparator website industry in Australia. This includes:
- Transparently disclosing which providers we compare and which we do not.
- Clearly explaining how our comparison results are generated and ordered.
- Disclosing our commercial relationships with participating providers.
- Ensuring our comparison methodology is fair and not biased by commercial arrangements.
- Providing clear and accurate product information to enable informed consumer decisions.
Financial Services Regulation
ComparisonHQ provides general product comparisons and information only. We do not provide personal financial advice, insurance advice, or credit assistance. Where our services involve regulated financial products (such as insurance), we operate within the relevant regulatory framework and will hold any required authorisations, licences, or exemptions as applicable.
We will clearly disclose our licensing status and any authorisations on the relevant pages of our website.
Energy Market Regulations
For energy comparisons, we operate in accordance with the requirements of the Australian Energy Regulator (AER) and the Electricity Retail Code. Energy pricing information is sourced from providers and, where available, from the government's Energy Made Easy platform to ensure accuracy.
Health Insurance Comparisons
For health insurance comparisons, we reference data from the Australian Government's PrivateHealth.gov.au platform and our participating health funds. We operate in accordance with the Private Health Insurance Act 2007 (Cth) and applicable industry codes.
Ongoing Compliance
We regularly review our compliance practices and update our policies and procedures to reflect changes in law, regulation, and industry best practice. Our team undergoes regular compliance training.
